Welcome to Pinto! Please read these Terms of Service (the "Terms") carefully before using the Pinto mobile application and related services (collectively, the "Service") operated by [Your Company Name] ("Pinto," "us," "we," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. User Content License
Pinto is a platform that encourages the sharing of user-generated content, including reviews, comments, ratings, podcast recommendations, profile information, and any associated media (collectively, "User Content").
By submitting User Content to the Service, you hereby grant Pinto a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, fully paid, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service and Pinto's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels.
You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to grant the foregoing license to Pinto.
2. Accounts and Eligibility
2.1 Account Creation
You must be at least 13 years of age to use the Service. When you create an account with us, you must provide information that is accurate, complete, and current. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
2.2 Account Security
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.
3. Monetization, Subscriptions, and Billing
3.1 Fees and Payment
Pinto reserves the right to charge fees for access to certain features or services ("Premium Features") through subscriptions or one-time In-App Purchases (IAP). You agree to pay all fees and charges associated with your purchase of Premium Features, and you authorize Pinto or its third-party payment processor to charge your selected payment method.
3.2 Subscriptions
Subscriptions are billed on a recurring basis (e.g., monthly or annually). Your subscription will automatically renew unless you cancel it at least 24 hours before the end of the current billing period. Pinto reserves the right to change the subscription fees upon prior notice.
3.3 Refunds
Except when required by law, payments for subscriptions and IAP are non-refundable.
4. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Pinto and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Pinto.
5. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
6. Limitation of Liability
In no event shall Pinto, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
7. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of [Insert Your Governing State/Country, e.g., the State of California], without regard to its conflict of law provisions.
